uEngage Services Private Ltd. (“uEngage”, “we”, “us”, or “our”) provides Business-to-Business (B2B) Software-as-a-Service (SaaS) to restaurants. The terms (“You”, “Your”, “Yourself” refer to the users, including visitors, registered customers, cloud kitchens, retail brands and end-users of our B2B (Business-to-Business) and SaaS (Software as a Service) ecosystem. Our platform consists of three core modules:

1. uEngage Edge: Direct online ordering applications, websites, and QR menus.
2. uEngage Prism: Customer Relationship Management(CRM), loyalty engines, and automated marketing (SMS/WhatsApp).
3. uEngage Flash: Fleet management, 3rd Part Logistics(3PL) dispatch, and real-time rider tracking.

User Information

To avail certain services on our Websites, users are required to provide certain information for the registration process namely:-

User-Provided Information:

1. Your unique id which may include but not limited to name, e-mail or mobile number,

4. Interests pertaining to food and order habits, and the like. The Information as supplied by the users enables us to improve our websites and provide you the most user-friendly experience.

Automatically Collected Data: IP addresses, browser types, and connection details to tailor user interests and also to measure traffic at a given point of time to ensure smooth functioning. Our web servers automatically collect limited information about your computer's connection to the Internet, including your IP address, when you visit our site. (Your IP address is a number that lets computers attached to the Internet know where to send you data - such as the web pages you view.) Your IP address does not identify you personally. We use this information to deliver our web pages to you upon request, to tailor our site to the interests of our users, to measure traffic within our site and let advertisers know the geolocations from where our visitors come.

Geolocation Data: We may collect location data to provide relevant advertisements and lifestyle discovery on the basis of your region by way of your interests based on your to cater you with relevant options available which may be customized as per your interests.

Cookies

To improve the responsiveness of the sites for our users, we may use cookies, or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification (User ID) to understand the user's individual interests using the Identified Computer. Unless you voluntarily identify yourself (through registration, for example), we will have no way of knowing who you are, even if we assign a cookie to your computer. The only personal information a cookie can contain is information you supply. A cookie cannot read any data from your device. Our advertisers may also assign their own cookies to your browser (if you click on their ads), which is beyond our control and we do not partake in it.

All required information is service dependent and we may use the above said user information to maintain, protect, and improve its services (including advertising services) and for developing new services. Such information will not be considered as sensitive if it is freely available and accessible in the public domain or is furnished under the Right to Information Act, 2005 or any other law for the time being in force.

Because we operate as a technology infrastructure provider, our legal obligations depend on whose data is being processed. This policy is divided into two parts: Part A For End Consumers and Delivery Riders, and Part B for our Merchants (Business Clients).

Part A: End-Consumer & Rider Data (Platform Users)

If you are an end consumer using a Merchant's app (powered by uEngage Edge), receiving marketing messages (via uEngage Prism), or a delivery rider utilizing our tracking infrastructure (uEngage Flash), this section applies to you.

Our Role as a Data Processor

Under the Digital Personal Data Protection (DPDP) Act, 2023, the restaurant, brand, or merchant you are interacting with (the “Merchant”) is the Data Fiduciary. uEngage acts strictly as a Data Processor.

1. Edge (Ordering): We collect your name, phone number, location, and order history strictly to facilitate your transaction on behalf of the Merchant. Payment processing is handled via secure third-party gateways; we do not store full credit card details.
2. Prism (Marketing & Loyalty): Any automated communications, loyalty points, or digital bills you receive are initiated by the Merchant. uEngage provides the software, but we do not use your data for our own marketing.
3. Flash (Delivery Logistics): If you are a delivery rider, your KYC details, attendance, and real-time GPS location are processed solely to execute dispatch and tracking for the Merchant.

Merchant Responsibilities (Consent & Notice)

The Merchant is legally obligated to:

1. Provide you with an itemized notice regarding what data is collected.
2. Obtain your verifiable, free, and unambiguous consent before processing your data, particularly before using uEngage Prism to send promotional campaigns via WhatsApp, SMS, or email.

Exercising Your Rights (Data Principal Rights)

Because uEngage merely hosts the data on behalf of the Merchant, we cannot directly fulfill data rights requests. To access, correct, or erase your data, or to withdraw your consent for marketing, you must contact the Merchant directly. If uEngage receives a direct request from you, our policy is to forward it to the respective Merchant for fulfillment. A user has the right to Nominate an individual to exercise their rights in the event of their death or incapacity.

Part B: Merchant & Website Visitor Data (B2B Policy)

If you are a business owner utilizing Edge, Prism, or Flash, or a visitor to uengage.io, uEngage is the Data Fiduciary for your information.

Information We Collect

1. Business Details: Name, business name, work email address, phone number, and billing information.
2. Platform Analytics: IP address, browser type, and usage metrics across the merchant dashboard to monitor system health and feature adoption.

Purpose and Retention

We process Merchant data to manage accounts, provide technical support, and improve our software. Merchant account data is retained for the duration of the active lease. Upon termination, profile data is deleted or anonymized within 30 Days from the date of request], excluding legally mandated financial records.

Mandatory Logging: In compliance with Digital Personal Data Protection (DPDP) Rules, 2023, uEngage retains system processing logs for a minimum of one (1) year to facilitate the detection of unauthorized access.

Security Safeguards & Breach Protocol

Data processed through Edge, Prism, and Flash is protected by industry-standard encryption (in transit and at rest) and strict access controls.

Breach Notification: In the event of a security breach affecting Merchant-controlled data, uEngage will notify the affected Merchant within 24 hours. This ensures the Merchant can fulfill their statutory duty to notify the Data Protection Board of India (DPBI) and affected consumers within the mandated 72-hour window.

Age Restrictions and Children's Privacy

Our website and B2B software services are designed strictly for business professionals and are not directed at, nor intended for use by, individuals under the age of 18 (minors). uEngage does not knowingly collect or solicit personal data from minors. If you are under 18, please do not attempt to register for our services or send any personal information to us. If we learn that we have inadvertently collected personal data from a minor without verifiable parental consent, we will delete that information immediately. If you believe that a minor has provided us with personal data, please contact our Grievance Officer immediately.
